Topic 118 WIPO Doha
Topic 118 — WIPO and Doha Declaration
The World Intellectual Property Organization (WIPO) is the United Nations specialised agency dedicated to fostering the creation and protection of intellectual property worldwide. Established by the Convention Establishing the WIPO (signed in Stockholm on 14 July 1967, effective 26 April 1970), WIPO operates from headquarters in Geneva, Switzerland with 192 member states. It administers 26+ international IP treaties — including the foundational Paris Convention (1883) and Berne Convention (1886), and modern treaties like the WIPO Copyright Treaty (1996), Beijing Treaty (2012), and Marrakesh Treaty (2013). WIPO's services include the Madrid System (international trademark), PCT (international patent), Hague System (international design), and Lisbon System (geographical indications). The Doha Declaration on TRIPS Agreement and Public Health (14 November 2001) is one of the most consequential international IP declarations — affirming that TRIPS does not and should not prevent members from taking measures to protect public health, and confirming flexibilities including compulsory licensing, parallel imports, and national grounds determination. Adopted at WTO Fourth Ministerial Conference in Doha, Qatar, the Declaration was driven by the HIV/AIDS crisis in Sub-Saharan Africa. India played a lead role and has been a major beneficiary of TRIPS flexibilities. The May 2024 WIPO Treaty on Intellectual Property, Genetic Resources and Traditional Knowledge — adopted at WIPO Diplomatic Conference — represents a significant new international framework. WIPO continues to operate cutting-edge programs on AI/IP, digital trade, and traditional knowledge. India's Director General Ministry-level cooperation has made India a key WIPO partner. This topic walks through WIPO institutional framework, services, recent treaties, and the Doha Declaration's legacy.
