Reliefs the Consumer Commission May Grant: The Section 39 Menu
Section 39 is where the Act pays off: the list of orders a Commission may pass once satisfied that the goods were defective, the service deficient, or the trade practice unfair or restrictive. The menu runs from the transactional, repair, replacement, refund, through compensation with punitive damages for the fit case, to the market-facing orders, discontinuance, hazardous-goods directions, class restitution and corrective advertisement. This note takes the menu item by item and explains how the reliefs combine in practice.
1. The Threshold
The section opens on satisfaction: where the Commission is satisfied that the goods complained against suffer from any of the defects specified in the complaint, or that any of the allegations about the services or the unfair trade practices are proved, it shall issue an order to the opposite party directing one or more of the reliefs. Two working consequences follow. Relief is tied to proof of the pleaded grievance, the laboratory finding, the established deficiency, the proved practice, which is why the complaint's prayer clause should ask for every relief the facts can carry, in the alternative where needed. And the reliefs are cumulative: 'one or more' means refund may come with compensation, discontinuance with corrective advertisement, and costs with everything.
2. The Menu
2.1 The transactional reliefs
- Removal of defects: to remove the defect pointed out by the appropriate laboratory from the goods in question, and, more generally, to remove the defects in the goods or the deficiencies in the services in question, the repair remedy, apt where cure is possible and proportionate.
- Replacement: to replace the goods with new goods of similar description, free from any defect, the remedy for the irreparable article, new means new, not the repaired unit returned.
- Refund: to return to the complainant the price or charges paid, with interest as the Commission awards, the exit remedy where confidence in the product or the bargain is gone; in possession-delay and failed-project cases the refund-with-interest order is the workhorse.
2.2 Compensation and punitive damages
The Commission may award compensation for any loss or injury suffered by the consumer due to the negligence of the opposite party, and the clause adds: including punitive damages in such circumstances as it deems fit. Compensation restores; punitive damages punish and deter, and the two are distinguished, with their governing case law, in the next note. Compensation orders commonly carry interest, and mental agony, harassment and litigation hardship are recognised heads in fit cases.
2.3 The market-facing reliefs
- Discontinuance: to discontinue the unfair trade practice or the restrictive trade practice and not to repeat it, the forward-looking injunction that outlives the individual dispute.
- Hazardous goods and services: not to offer hazardous or unsafe goods for sale; to withdraw hazardous goods from being offered; and to cease manufacture of hazardous goods and desist from offering hazardous services, the safety block, the Commissions' counterpart of the CCPA's recall power.
- Class restitution: where a large number of consumers, not identifiable conveniently, have suffered loss or injury, to pay such sum as the Commission determines (the statute fixing a floor by reference to the value of the defective goods or services), credited for use in the prescribed manner in consumer welfare, wrongdoing profitable only because its victims are dispersed is stripped of its gains.
- Corrective advertisement: to issue corrective advertisement to neutralise the effect of a misleading advertisement, at the cost of the opposite party, the falsehood unsaid in the market that heard it.
- Costs: to provide adequate costs to the parties, which, with the adjournment-costs discipline, keeps the summary forum's economics honest.
3. The Reliefs in Combination
- The defective product: repair where curable; replacement or refund with interest where not; compensation for consequential loss where negligence is shown; laboratory costs following the event.
- The deficient service: removal of the deficiency where performance can still be compelled (possession delivered, the policy honoured); refund with interest where the consumer exits; compensation for the delay's cost and the agony proved.
- The unfair practice: discontinuance with the undertaking not to repeat; refund of amounts extracted; corrective advertisement where the practice advertised; and in dispersed-harm cases, the class-restitution order.
- The hazardous product: the sale ban, withdrawal and cease-manufacture trio, with compensation to the injured and the CCPA's parallel recall machinery where the harm is market-wide.
- Execution: every order is enforceable as a decree (Section 71), with Section 72 imprisonment behind disobedience, the menu is only as good as its enforcement, and the Act supplies it.

Read as a whole, Section 39 is the Act's theory of remedy in one list: cure the thing, unwind the bargain, restore the loss, stop the practice, protect the market, and make the wrongdoer pay for the correction, with the Commission free to combine whichever orders the proved grievance requires.
