Motor Vehicles Act, 1988
Can You Drive a Commercial Vehicle on a Private Car Licence?
For the light ones, yes. After Mukund Dewangan and the Constitution Bench's affirmation in Rambha Devi, an ordinary LMV licence authorises driving a transport vehicle whose gross vehicle weight does not exceed 7,500 kilograms, taxis, app cabs and light goods carriers included, with no separate transport endorsement. The vehicle's own commercial papers, permit, fitness, tax, and any State or platform badge rules, are a different checklist that still applies.
1. The answer in brief
- The rule: the LMV licence covers transport vehicles up to 7,500 kg gross vehicle weight, settled by Mukund Dewangan (2017) and unanimously affirmed by five judges in Rambha Devi (2024).
- What it means on the road: the car licence holder may lawfully drive the registered taxi, the app cab, the small delivery van and the light goods carrier.
- Above 7,500 kg: the transport class governs, with its age of twenty, the one year LMV experience for the learner's stage, medical certificates and five year renewals.
- Insurers are bound: claims cannot be repudiated merely because the light commercial vehicle's driver held only an LMV licence.

2. What the ruling does not change
Figure 2: Four checklists, one cab
- The vehicle's regime: commercial use needs the transport registration, the permit, fitness certificate, commercial tax and insurance; the driver's licence was only ever one item on the list.
- State and platform layers: several States require badges or verification for cab drivers, and aggregator rules add training, police checks and medicals; these operate alongside the licence, not through it.
- Special endorsements the rules attach, hazardous goods carriage above all, continue by their own force whatever the weight.
- Gross vehicle weight is read off the RC, so the registration certificate answers the only factual question the rule leaves open.
3. Quick Revision
✦ The 7,500 kg rule in five lines Rule: LMV licence covers transport vehicles to 7,500 kg GVW. Authority: Mukund Dewangan (2017); Rambha Devi (2024), five judges, unanimous. Above the line: transport class, age 20, experience, medicals, 5 year renewals. Unchanged: permits, fitness, tax, badges and platform rules for the vehicle and trade. Insurance: the missing endorsement alone defeats no claim. |
- Read the GVW from the registration certificate.
- Drive the light commercial vehicle on the LMV licence, lawfully.
- Keep the vehicle's commercial papers current.
- Meet the State's badge and platform rules separately.
- Cite both cases together in any dispute.
4. Frequently Asked Questions
So can I start driving for a cab platform tomorrow on my ordinary car licence?
Your licence is ready; the rest of the checklist decides tomorrow. The platform will want the vehicle commercially registered with its permit and commercial insurance, your police verification and training under the aggregator rules, the State's badge where one is required, and its own onboarding; none of that touches the licence question the Constitution Bench closed, and none of it is waived by it either. Drivers using their own private car face the larger conversion, white plate to yellow, with the tax and insurance consequences of commercial registration. The clean mental model: Rambha Devi settled what the human may drive; the permit and aggregator chapters govern what the vehicle and the trade require, and a lawful cab needs all three columns ticked.
Does the 7,500 kg rule cover buses and tempos carrying passengers?
By weight, yes; by practice, check the machine. The rule is indifferent to whether the transport vehicle carries goods or passengers, so a passenger carrier whose gross vehicle weight sits within 7,500 kilograms, the small tempo traveller class and vans among them, is within the LMV licence's authority, and e rickshaw drivers besides have their own eased route. Full size buses exceed the weight and belong to the transport class with its stricter entry, and several States' permit conditions for passenger carriage add driver requirements of their own that operate regardless of the licence class. The registration certificate's GVW entry, again, is the decisive datum; disputes about what a driver could lawfully drive begin and usually end there.
