Motor Vehicles Act, 1988

Can You Get Compensation If the Other Vehicle Is Never Traced?

Yes. Where the vehicle's identity cannot be traced despite reasonable efforts, the hit and run scheme pays two lakh rupees for death and fifty thousand for grievous hurt, through the district's claims enquiry machinery rather than a tribunal; and if the vehicle surfaces later, the full claim reopens with the scheme's payment adjusted. The right survives the untraced wrongdoer, which is the scheme's whole point.

1. The answer in brief

  • The sums: two lakh rupees for death, fifty thousand for grievous hurt, under section 161 and the hit and run scheme, for accidents from 1 April 2022.
  • The route: application to the district claims enquiry officer with the FIR recording the unknown vehicle, the post mortem or injury records and the claimant's documents; the settlement authority sanctions and the designated insurer pays.
  • No negligence inquiry: the scheme asks that the accident happened and the vehicle stayed untraced, nothing more.
  • Police must tell you: the Supreme Court has directed in the road safety litigation (S. Rajaseekaran, 2024) that police inform hit and run victims' families of the scheme, which remains under claimed.
  • If traced later: the ordinary tribunal claim lies against owner and insurer, the scheme amount refunded or adjusted.

2. The wider net

  • The Accident Fund (section 164B) stands behind the scheme, built to carry golden hour treatment, hit and run compensation and such other relief as the Centre prescribes.
  • Golden hour treatment runs on its own scheme: cashless initial care for accident victims, the untraced vehicle's victim included, hospitals claiming from the scheme rather than the patient.
  • Partial information cases: a vehicle identified but uninsured sends the claim against the owner personally, award and execution; a vehicle identified late converts the scheme file into the tribunal claim with the records already built.
  • Documentation wins these cases: the FIR's unknown vehicle recital, dated medical papers and the claimant's relationship documents are the whole file; keep them from the first day.

3. Quick Revision

✦ The untraced vehicle in five lines

Section 161: 2 lakhs death, 50,000 grievous hurt.

Route: district claims enquiry officer; settlement authority; designated insurer.

No fault inquiry: untraced identity is the only special fact.

Police duty: victims must be informed of the scheme.

Tracing later: full tribunal claim, with set off of the scheme's payment.

  1. Record the vehicle as unknown in the FIR itself.
  2. Apply to the district machinery, not the tribunal.
  3. Preserve the medical and relationship papers.
  4. Ask the police about the scheme; the duty is theirs.
  5. Reopen fully if the vehicle ever surfaces.

4. Frequently Asked Questions

CCTV shows a partial number plate. Is the vehicle traced or untraced?

The scheme's test is identity unascertainable despite reasonable effort, and a partial plate sits exactly on the line: the police owe the reasonable effort, running the fragment against the register's candidates, and the case is untraced only when that effort honestly fails. Families should press the investigation before and while applying, since a traced vehicle's tribunal claim dwarfs the scheme's sums for an earning deceased; the scheme application can follow if tracing stalls, and nothing is lost, the payment adjusting against any later award. The practical sequence: give the police every fragment, camera clip and witness, in writing; diary the follow ups; and treat the scheme as the floor it was designed to be, not the ceiling an incomplete investigation makes it.

Who exactly can apply under the scheme, and is there a time limit?

The injured person applies for grievous hurt, and the legal representatives, the spouse, children, parents and the heirs the claims law recognises, apply for a death, with the scheme's forms naming the usual documents, identity, relationship and the bank account the payment reaches. The scheme prescribes its own application window and condonation machinery, and because scheme periods and sums are revised by notification, the current scheme document should be checked when applying; the constant across versions is documentary simplicity, the FIR, the medical record and the relationship proof carrying the whole claim. Where the family missed the scheme entirely, the road safety litigation's direction that police inform victims supplies the argument for condonation, the State's own lapse explaining the delay.
