Motor Vehicles Act, 1988
Is a Driving Licence from One State Valid in Another State?
Yes, completely. Section 13 makes a driving licence effective throughout India, so a licence issued in Kerala drives lawfully in Delhi, Assam or anywhere else, with no endorsement, conversion or local permit. The confusion comes from the vehicle, whose registration and road tax do respond to a permanent move; the licence itself asks nothing more than renewal on time, which any licensing authority can now do.
1. The answer in brief
- Section 13: a licence is effective throughout India; demanding a local licence is unlawful.
- No conversion exists or is needed: the national Sarathi database holds one record, and renewals and duplicates can be processed where you now live.
- Address update is housekeeping: changing the licence's address helps correspondence and renewals but is not a condition of driving in the new State.
- The vehicle is the real checklist: beyond twelve months' stay, the car needs the new State's registration mark under section 47, with road tax adjusted, unless it carries a BH series mark.

2. The law behind it
- One licence, one record: the one person one licence rule of section 6 pairs with India wide effect, so a second local licence is not only unnecessary but an offence.
- Renewal from anywhere: the renewal application can be made to the authority where you now ordinarily reside, with the national database making the old State's record available; the one year window and the fresh test beyond it apply as usual.
- Employers and verifications sometimes demand local addresses; that is their policy, not the Act's requirement.
- For vehicles, the twelve month rule, the NOC machinery and the BH series are the governing trio, each covered in its own place.

3. Quick Revision
✦ Licence portability in five lines Section 13: valid throughout India, no conversion. Section 6: one licence; never take a second locally. Renewal: at the authority of your current residence, on the national record. Address change: convenience, not a condition of driving. Vehicle: twelve months, then the new State's mark; BH series spares the cycle. |
- Drive on the existing licence anywhere, confidently.
- Update the address when convenient.
- Renew on time, wherever you now live.
- Run the vehicle's twelve month clock separately.
- Refuse any demand for a local licence as baseless.
4. Frequently Asked Questions
I have moved permanently. Should I get the licence reissued from the new State?
Only in the sense of updating the record, and only when convenient. The lawful course is a change of address application, online in most States, which re-homes your licence record to the new authority without any fresh test or new licence number in substance; renewal, when it falls due, then happens locally without friction. What you must never do is apply for a fresh licence as if you had none, since holding two licences breaches section 6 and surfaces instantly on the national database, complicating both records. NRIs and long absentees follow the same logic: the Indian licence remains valid for driving in India regardless of the holder's residence, renewal can be handled on return or through the processes States provide, and foreign driving runs on the IDP machinery rather than on any relocation of the licence.
Can a traffic officer in another State challan me for an out of State licence or vehicle?
Not for the licence, ever: an out of State licence is simply a licence, and a challan premised on its origin is baseless and worth contesting. The vehicle is different in defined ways: an out of State registration is itself lawful, but officers may legitimately act where the twelve month re registration window has passed, where State road tax has become due by the vehicle's continued keeping, or where local restrictions, the NCR's age caps for instance, bar the vehicle's class. The practical defence is evidence of the stay's length, tickets, leases and tolls showing recency, and compliance once the stay turns permanent. The clean separation to remember: the person's licence is national; the machine's papers are territorial after a year.
