Taxation of Motor Vehicles: Entries 56 and 57 and the Trade Question

The vehicle is regulated mainly through Union law but taxed by the States: Entry 57 of the State List carries the tax on vehicles, Entry 56 the tax on carried goods and passengers, both working within the Constitution's trade and commerce discipline. The subject matters to motor vehicle law because taxation decides where vehicles register, how permits price, and why reforms like the composite fee and the BH series exist.

1. The fiscal architecture

  • Entry 57, List II: State taxes on vehicles, whether mechanically propelled or not, suitable for use on roads, expressly subject to Entry 35 of the Concurrent List, under which Parliament may lay down principles of taxation for mechanically propelled vehicles.
  • Entry 56, List II: State taxes on goods and passengers carried by road or on inland waterways, the basis of passenger and goods taxes on operators.
  • Suitability, not use: the taxable event under Entry 57 is the vehicle's suitability for road use, so a registered vehicle kept off the road stays taxable until the owner takes the non use route the State law provides.
  • State Acts: each State's motor vehicles taxation Act fixes rates, exemptions, refunds and non use declarations, which is why the figures differ across every border.

2. The trade and commerce discipline

  • Article 301 guarantees freedom of trade, commerce and intercourse through India, and transport levies were its earliest battlefield.
  • The classical cases divided over when a tax impedes trade: Atiabari Tea Co (1961) treated levies that directly and immediately burden movement as needing Article 304 compliance, while Automobile Transport (Rajasthan) (1962), a motor vehicle tax case, sustained compensatory charges that pay for the roads and facilities trade uses.
  • The modern position: a nine judge bench in Jindal Stainless v State of Haryana (2016) resolved the long dispute in the entry tax litigation, discarding the compensatory tax doctrine and holding that non discrimination is the operative test, a State tax falls foul of the freedom only where it discriminates against goods or trade from other States under Article 304(a).
  • For vehicle taxes the upshot is stability: ordinary, even handed road and carriage taxes stand, and challenges succeed where a State prices outside vehicles or goods above its own.

3. The working forms

The four shapes of vehicle tax

Figure 2: The four shapes of vehicle tax

  • One time tax: private vehicles commonly pay a long term tax at registration, which is why inter State migration historically triggered double taxation grievances and slow refunds.
  • Transport vehicle taxes: periodic, scaled by seating capacity, laden weight and use, and tied to the permit's class.
  • Composite fees: the national permit and all India tourist regimes replaced border by border taxation with a single authorisation payment shared among States, trunk transport's fiscal peace treaty.
  • The BH series: road tax charged in two year blocks that travel with the transferable owner, the 2021 answer to the one time tax's migration problem.
  • Enforcement: tax runs with the registration record, arrears block transfers and NOCs, and detention powers back collection under the State Acts.

⚠ Key point

Three anchors carry the topic: Entry 57 taxes the vehicle's suitability for road use, subject to Parliament's Entry 35 principles; Entry 56 taxes the carriage of goods and passengers; and the freedom of trade challenge now turns on discrimination under Article 304(a), so even handed road taxes stand. The composite fee and the BH blocks are the system's practical reforms.

4. Quick Revision

✦ Vehicle taxation in five lines

Entry 57: vehicles suitable for road use; subject to Entry 35 List III.

Entry 56: goods and passengers carried by road.

Test today: non discrimination under Article 304(a), Jindal Stainless (2016).

Forms: one time tax; periodic transport taxes; composite permit fees; BH two year blocks.

Incidence: suitability, not actual use; non use declarations route the exception.

  1. Name the entry before the levy.
  2. Test challenges on discrimination, not burden.
  3. Use composite fees for inter State operations.
  4. Route migration cases through refunds or the BH series.
  5. Collect arrears through the registration record.

5. Frequently Asked Questions

Why does road tax differ so much between States?

Because the power is genuinely State level. Entry 57 lets each legislature price vehicle ownership for its own roads, and the State taxation Acts choose different bases, ad valorem on the vehicle's cost in some States, slabs by engine and type in others, with electric exemptions and luxury surcharges layered by policy; Parliament's power to prescribe uniform principles under the Concurrent List has been used sparingly, so divergence is the default. The practical consequences are familiar: buyers registering across borders for lower tax, enforcement against out of State registrations, and the twelve month re registration rule doing fiscal as well as administrative work. The composite fee and BH mechanisms are the system's negotiated exceptions, built precisely because three dozen different schedules and a mobile economy grind against each other.

Can a State demand its tax from a vehicle registered elsewhere?

Once the vehicle is kept in the State for use, yes. The levy attaches to vehicles used or kept for use in the State, so the visitor passing through owes nothing beyond composite regimes, while the resident running a home State registration indefinitely does; the twelve month registration rule and the tax liability travel together, and enforcement drives against long stationed outside vehicles rest on exactly this incidence. Disputes cluster on proof of keeping, employment, residence and parking records deciding them. Students and short posting professionals generally escape as temporary; settlers do not, and the BH series exists so the genuinely transferable workforce can comply without serial re registration. The analytical point: registration fixes the record, but taxation follows the vehicle's real situs of use.

How does taxation interact with permits and the Motor Vehicles Act?

As parallel conditions on the same operation. The Act's permits authorise the use; the State's tax Acts price it; and the two meet in enforcement, where tax clearance is demanded at permit grant and renewal, countersignature and NOC stages, and unpaid tax grounds detention under the State law alongside the Act's own powers. The composite fee shows the deliberate integration: a national permit's single payment satisfies the participating States' taxes for the authorised vehicle, collapsing two regimes into one transaction. For exam purposes, keep the sources straight, the permit from the Union Act's machinery, the tax from the State Act under Entry 56 or 57, and remember that a vehicle can be perfectly permitted yet detained for tax, or fully taxed yet unauthorised for want of a permit.
