Motor Vehicles Act, 1988
What Happens If Your Driving Licence Expires? Renewal and Risk
The licence dies on its expiry date, and driving after it is unlicensed driving with the five thousand rupee penalty; but the law leaves a repair window, renewal without any fresh test for up to one year after expiry, and only beyond that year does the fresh competence test apply. The trap is the middle: the renewal window forgives the paperwork, never the driving done inside the gap.
1. The answer in brief
- Renewal window: apply one year before to one year after expiry under section 15; within it, renewal issues on the application, fee and, where applicable, the medical certificate.
- Beyond one year: the licence cannot be renewed; a fresh test of competence under section 9(3) is required, effectively a new licence journey.
- Driving in the gap is an offence: the expired licence confers no authority, so the five thousand rupee penalty for unlicensed driving, and the insurance consequences, attach from the day after expiry.
- Medicals: transport licences and applicants past forty attach the fitness certificate on renewal; transport licences also renew on the shorter five year cycle.

2. The law behind it
- Section 15's design: the 2019 amendment widened the old thirty day grace to a full year on each side, trading strictness on paperwork for strictness on driving; the authority renews from the application's date in late cases.
- In claims, an expired licence invites the insurer's defence, fought on the Swaran Singh framework: technical and short lapses by competent drivers have often been held immaterial to the accident, while long expiry shades into substantive unlicensing; either way the victim is paid first.
- At the roadside, digital records expose expiry instantly, and e challans issue without a stop; the document in the wallet no longer hides the date.
- Renewal is now largely online, with the application, fee and medical upload on the portal and the renewed licence issued against the same record.

3. Quick Revision
✦ Expiry in five lines Window: one year before to one year after expiry, no fresh test. Beyond a year: section 9(3) test, start again in substance. The gap: driving on an expired licence is unlicensed driving, 5,000 rupees. Medicals: transport and forty plus renewals attach the certificate. Claims: materiality decides the insurer's defence; victims paid regardless. |
- Renew in the year before expiry, not after.
- Stop driving on the expiry date, not the challan date.
- Use the online renewal before the year runs.
- Keep the medical ready past forty.
- Fight materiality, not the calendar, in claims.
4. Frequently Asked Questions
My licence expired during a long stay abroad. What are my options now?
The calendar governs, wherever you were. Within the year after expiry, renew online or through the home authority on the usual papers, the absence abroad being irrelevant to the window; beyond the year, the fresh test requirement applies and no equitable extension exists in the section, though the process rides on your old record rather than starting from a learner's zero in practice. NRIs therefore calendar the expiry like a passport's: a renewal effected on a visit home inside the window costs an hour, while a lapse beyond it costs the test queue. Driving abroad meanwhile runs on the host country's recognition of the licence and IDP, both of which also die with the underlying document, which is one more reason the renewal should never wait for the return flight.
Is there any defence if I was challaned the week after expiry?
Mitigation, not immunity. The offence is complete on the expired document, and the challan is lawful from the first day of the gap; what the week old lapse supports is the practical case for the minimum response, composition at the notified amount with the renewal receipt in hand, since authorities and courts distinguish the forgetful from the defiant. Renew before contesting anything: the renewed licence, dating the application inside the window, shows the lapse as clerical and shortens every conversation. The deeper point the question tests is the separation the section draws, a generous repair window for the document and zero tolerance for driving within the gap, and the only safe practice is treating the expiry date as the day the car keys pause.
