POCSO Act, 2012

The POCSO Act and Other Laws

No POCSO case is decided under the POCSO Act alone. The offence may also be one under the Bharatiya Nyaya Sanhita or the IT Act; the procedure runs through the BNSS; the evidence through the Bharatiya Sakshya Adhiniyam; the child's care through the Juvenile Justice Act; and questions of marriage, pregnancy, disability, legal aid and monitoring bring in five more statutes. Two provisions govern the whole relationship: Section 42, the greater punishment rule, and Section 42A, the overriding effect clause. This note maps POCSO against each of these laws.

1. The Governing Provisions

§ Sections 42 and 42A, and the special law principle

Section 42: alternative punishment. Where an act is an offence under POCSO and also under the listed provisions of the Penal Code, now the BNS, or Section 67B of the IT Act, the offender is liable to the punishment greater in degree. It is imposed once; the punishments are not added.

Section 42A: overriding effect. The Act is in addition to and not in derogation of other laws, but where there is an inconsistency, POCSO prevails to the extent of it.

Special law and general law. The maxim generalia specialibus non derogant means the special law governs its field and the general law fills gaps. Section 42A makes this explicit, and Section 31 applies the general procedure only where the Act makes no special provision.

References to the repealed codes in the Act are read as references to the BNS, BNSS and BSA under Section 8 of the General Clauses Act, 1897.

3. POCSO, the IT Act and Cybercrime Law

§ How the two statutes work together

• Section 67B of the IT Act punishes publishing, transmitting, creating, collecting, browsing, downloading, advertising or distributing material depicting children in sexually explicit acts, grooming children online, facilitating online abuse, and recording abuse.

• Jurisdiction. Under Section 28(3) of POCSO, the Special Court tries Section 67B offences.

• Punishment. Section 42 names Section 67B, so where both apply, the greater punishment is imposed.

• Intermediaries. Section 79 of the IT Act and the Intermediary Rules, 2021 condition safe harbour on due diligence and require proactive measures against child sexual abuse material; Section 20 of POCSO and Rule 11 require reporting.

• Harish (2024 INSC 716) read Section 15 of POCSO and Section 67B together, holding that 67B covers browsing and downloading.

4. POCSO and the Juvenile Justice Act, 2015

§ Complementary, not competing

The victim is a child in need of care and protection under Section 2(14) of the JJ Act, and the Child Welfare Committee decides on care, with the POCSO Rules requiring the police to engage it within twenty-four hours.

The offender who is a child is dealt with under the JJ Act, by virtue of Section 34(1) of POCSO; for a heinous offence by a child of sixteen to eighteen, the Board conducts a preliminary assessment under Section 15.

Age is determined for both under Section 94 of the JJ Act, applied through Section 34(2) of POCSO.

Identity is protected under Section 74 of the JJ Act as well as Section 23 of POCSO.

5. POCSO and the Child Marriage Law

i. The Prohibition of Child Marriage Act, 2006 makes a child marriage voidable under Section 3 and void in the cases in Section 12, and punishes an adult male who marries a child under Section 9.

ii. POCSO has no marital exception, so a sexual act with a minor spouse is an offence, and marriage is no defence.

iii. Section 42A makes POCSO prevail over personal law that permits a younger marriage.

iv. Independent Thought v. Union of India, (2017) 10 SCC 800, relied on POCSO to read down the marital exception in the Penal Code to eighteen.

6. POCSO and the Medical Termination of Pregnancy Act, 1971

§ Pregnancy resulting from an offence

The MTP Act, as amended in 2021, allows termination up to twenty weeks on one practitioner's opinion, and up to twenty-four weeks for specified categories including minors and survivors of sexual assault; beyond that, courts have permitted termination in appropriate cases.

Consent. A minor's termination requires the guardian's written consent, and the minor's own wishes are central.

The reporting tension. Section 19 of POCSO requires a practitioner to report. In X v. Principal Secretary, Health and Family Welfare Department (2022), the Supreme Court held that the practitioner need not disclose the minor's identity in the report where she and her guardian seek a lawful termination.

7. POCSO and the Rights of Persons with Disabilities Act, 2016

§ Protecting the child with a disability

• Aggravation. Taking advantage of a child's mental or physical disability aggravates the offence under Sections 5(k) and 9(k).

• Communication. Special educators and persons familiar with the child's communication assist under Sections 26(3) and 38(2), consistently with the RPwD Act's guarantee of reasonable accommodation and equal access to justice.

• The adult with an intellectual disability. Under Eera v. State (NCT of Delhi), (2017) 15 SCC 133, POCSO applies by chronological age only; such an adult is protected by the general criminal law and by the RPwD Act's own offences and safeguards.

8. POCSO and the Legal Services Authorities Act, 1987

i. Section 12 of the LSA Act entitles every child to free legal services.

ii. Section 40 of POCSO and Rule 7 give the child's family a lawyer through the Legal Services Authority where they cannot afford one.

iii. The DLSA is also the channel through which compensation and special relief are often paid under the victim compensation scheme.

9. POCSO and the Commissions for Protection of Child Rights Act, 2005

i. Section 44 of POCSO gives the NCPCR and SCPCRs the additional function of monitoring the Act, with their inquiry powers under the 2005 Act.

ii. Rule 12 sets out how they monitor Special Courts, Special Public Prosecutors, guidelines, training and awareness.

iii. Section 28(1) proviso: a Court of Session notified as a Children's Court under the 2005 Act is deemed a Special Court under POCSO.

What happens when an act is an offence under POCSO and the BNS?
