Right to Fair Compensation Act
The Administrator and the Commissioner for Rehabilitation and Resettlement: Sections 43 and 44
Rehabilitation gets its own officers because the Act does not trust acquisition to grade its own homework: the Administrator who makes and executes the scheme, and the Commissioner who supervises him and audits the result after the families have moved. Sections 43 and 44 create the pair. This note covers their appointment, functions, and the accountability design they embody.
1. The Administrator: Section 43
- Appointment and trigger: where the appropriate Government is satisfied that there is likely to be involuntary displacement of persons due to an acquisition, it appoints, by notification, an officer not below the rank of Joint Collector, Additional Collector, Deputy Collector or equivalent official of the revenue services as the Administrator for Rehabilitation and Resettlement, displacement, not acquisition as such, is what summons the office.
- Functions: the Administrator carries the R&R process end to end, subject to the appropriate Government's superintendence and control: the survey and census of affected families (Section 16), the draft R&R scheme with its entitlements, resettlement area and implementation time limit, the scheme's public hearing in the affected area, its submission through the Collector, and then the scheme's formulation, execution and monitoring as approved.
- Support: the Act contemplates the Administrator being provided the professional and administrative assistance the task needs, his office is the working face of rehabilitation in the field.
2. The Commissioner: Section 44
- Appointment: the State Government appoints an officer of the rank of Commissioner or Secretary of that Government as the Commissioner for Rehabilitation and Resettlement, seniority chosen so that the supervisor of rehabilitation outranks the district machinery he reviews.
- Functions: the Commissioner is responsible for supervising the formulation of the R&R schemes and their proper implementation, the approving authority to whom the Collector forwards the draft scheme with suggestions (Sections 17 and 18), and the standing reviewer of execution thereafter.
- The social audit: the Commissioner's signature duty: conducting the post-implementation social audit, in consultation with the Gram Sabha in rural areas and the municipality in urban areas, the scheme's promises read back, item by item, before the community they were made to, after the project has what it wanted and the incentive to perform has passed.
3. The Accountability Design
Officer | Rank | Role in the R&R cycle |
|---|---|---|
Administrator for R&R | Not below Joint, Additional or Deputy Collector or equivalent | Census and survey; drafts the scheme; holds its hearing; executes and monitors it |
Collector | The district's acquisition authority | Reviews the draft scheme with suggestions; passes the Section 31 R&R awards; ensures Third Schedule amenities (Section 32) |
Commissioner for R&R | Commissioner or Secretary to Government | Approves the scheme; supervises implementation State-wide; conducts the post-implementation social audit with the Gram Sabha or municipality |
The design separates three temptations. The officer who drafts entitlements (Administrator) is not the officer who approves them (Commissioner), so the scheme is not graded by its author; the officer who acquires (Collector) does not control rehabilitation's standards, so the pressure to deliver possession cannot quietly thin the package; and the audit happens after implementation, before the affected community itself, so performance is measured where it was promised. In the field the offices are often held ex officio alongside revenue duties, and the critical literature's standing complaint, that rehabilitation administration is acquisition administration wearing a second hat, is about practice, not design; the Act's answer is the Commissioner's independence of rank and the audit's publicity, and Topic 124 weighs how far that answer has worked.
⚠ Key point Section 43: an Administrator for R&R (not below Joint, Additional or Deputy Collector rank) is notified wherever involuntary displacement is likely: census, draft scheme, hearing, execution and monitoring, under the Government's superintendence. Section 44: a Commissioner for R&R (Commissioner or Secretary rank) supervises scheme formulation and implementation and conducts the post-implementation social audit with the Gram Sabha or municipality. Drafting, approval, acquisition and audit sit in different hands, rehabilitation designed not to grade itself. |
