Right to Fair Compensation Act
Determination of the Amount of Compensation: Section 27
Section 27 is the hinge of the compensation chapter: having determined the market value under Section 26, the Collector calculates the total amount of compensation by including all assets attached to the land and the further heads the Act directs. One sentence of statute, but it is the sentence that turns a valuation into an award, and the map of how Sections 26 to 30 fit together. This note states the rule and assembles the architecture around it.
1. The Rule
The Collector, having determined the market value of the land to be acquired, shall calculate the total amount of compensation to be paid to the landowner whose land has been acquired, by including all assets attached to the land. The section does three jobs. It makes Section 26's figure a component, not the conclusion: market value is the base on which the total is built. It mandates the inclusion of assets, the buildings, trees, wells, standing crops and attached plant that Section 29 values, so the award prices the property as it stands, not the bare earth. And it names the landowner in the Act's four-limbed sense (Topic 15), so the forest-rights holder and the assignee take the calculated total in their own right.
2. The Architecture of Sections 26 to 30
Provision | Function | Output |
|---|---|---|
Section 26 | Determines market value: highest of circle rate, higher-half sales average, consented price, as on the notification date | The base figure |
First Schedule | Applies the multiplier: 1 urban, 1 to 2 rural by notified distance | Multiplied market value |
Section 29 | Values the assets attached: buildings, trees, wells, crops, with specialist help where needed | The asset addition Section 27 mandates |
Section 28 | Directs the factors the Collector must consider in determining compensation: the land's situation, injurious severance, residual damage and the rest | Adjustments and additions on the facts |
Section 30 | Imposes solatium of 100% on the total, and the 12% per annum additional market value from the SIA notification to award or possession | The final award amount |
Section 27 is the thread through the table: it is the instruction to run the whole sequence and sum it. In examination terms, "how is compensation determined under the 2013 Act" is answered by walking this architecture; in practice, an award that quotes a market value and stops, without the assets, the Section 28 consideration or the solatium arithmetic, is incomplete on its face and invites the reference.
3. The Cost of Acquisition Distinguished
The compensation Section 27 calculates is what the landowner receives; the Act's cost of acquisition is the larger sum the Requiring Body bears, and the two should not be confused. The cost includes the awarded compensations, but also the R&R package with its Second Schedule entitlements and Third Schedule infrastructure, the administrative and SIA expenses, and the other charges the definition sweeps in (Topic 14). The design allocates accurately: the owner is made whole through Section 27's total, the displaced family is rebuilt through the R&R award, and the project pays for both, because both are costs the project caused. Equally distinct is the R&R award itself (Section 31): compensation under Section 27 answers ownership, while the R&R award answers displacement, and an affected family may hold one, the other or both.
⚠ Key point Section 27: the Collector, having fixed the Section 26 market value, calculates the total compensation by including all assets attached to the land, and the total then takes Section 28's factors and Section 30's 100% solatium and 12% additional amount. The section is the compensation chapter's hinge: market value is a component, assets are mandatory, the landowner takes the total in the Act's wide sense, and the cost of acquisition the project bears is larger still, compensation plus the whole R&R package and expenses. |
