Right to Fair Compensation Act

The Multiplier Factor and the First Schedule

The 2013 Act's famous promise, up to twice market value in cities and four times in the countryside, is manufactured by the First Schedule: a multiplier on rural market value, the separate valuation of assets, and a solatium that doubles the lot. This note explains the multiplier, walks the full computation in a worked table, and covers who fixes the factor and the questions it has raised.

1. The Multiplier

  • Urban areas: the factor is one, market value passes through unmultiplied, the premium for urban owners coming from solatium alone.
  • Rural areas: the factor is one to two, to be notified by the appropriate Government, based on the distance of the project from the urban area, the farther the land from the town, the higher the factor, on the logic that remote rural markets understate value most and rural livelihoods are hardest to rebuild.
  • Who fixes it: the appropriate Government notifies the factor and its distance bands, so the multiplier actually applied in a given acquisition is a matter of the State's (or the Centre's) notification, several States began at the floor, notifying a factor of one even for rural land, and the choice has been the subject of policy argument ever since (Topic 103 collects the notifications).

2. The Full Computation

The First Schedule assembles compensation in ordered steps, each building on the last:

Step

Component

How computed

1

Market value

Section 26: highest of circle rate, higher-half sales average, consented price

2

Multiplied value

Market value times the factor: 1 urban; 1 to 2 rural by notified distance

3

Assets attached to land

Section 29: buildings, trees, wells, crops and the rest, valued separately and added

4

Subtotal

Multiplied market value plus assets: the amount on which solatium runs

5

Solatium

Section 30: 100% of the subtotal, for the compulsion

6

Final compensation

Subtotal plus solatium: twice the subtotal, plus the 12% per annum additional amount from the SIA notification to award or possession

A worked example fixes the mechanics. Rural land, market value 10 lakh, notified factor 2, assets worth 3 lakh: multiplied value 20 lakh, plus assets 3 lakh, subtotal 23 lakh, solatium 23 lakh, final compensation 46 lakh, plus the 12% additional amount for the interval. The same land inside a city, factor 1: subtotal 13 lakh, award 26 lakh. Hence the shorthand, up to four times rural, two times urban, exact only when the rural factor is 2 and assets are ignored, but faithful to the design.

3. Reading the Schedule

  • Solatium multiplies everything: because the 100% solatium runs on the subtotal, every rupee of market value, multiplier and assets is a rupee doubled, which is why valuation disputes under this Act are fought with twice the old intensity.
  • The factor is law, not discretion: once notified, the factor applies as a rule of computation; the Collector cannot award a rural factor below or above the notification, and a State's choice of a uniform factor of one for rural land, while lawful under the Schedule's words, defeats the differential the Schedule contemplates and has drawn criticism on exactly that ground.
  • The Schedule travels: by the Removal of Difficulties Order and Section 105's alignment, the First Schedule's compensation reaches acquisitions under the Fourth Schedule enactments from 1 January 2015, highways and railways pay the same formula (Topic 88), and in Tarsem Singh (2019) the Supreme Court extended solatium and interest to National Highways Act acquisitions on this logic (Topic 120).
  • Where it binds States: State amendments have trimmed SIA and consent, but the First Schedule's compensation has largely been left intact, the politics of paying farmers less being what it is; the factor notification is where the quiet dilution happens.

⚠ Key point

The First Schedule: market value times the multiplier (1 urban; 1 to 2 rural by notified distance from the urban area), plus Section 29 assets, plus 100% solatium on the whole, with the 12% per annum additional amount running from the SIA notification to award or possession: in round terms up to twice market value urban and four times rural. The factor is fixed by the appropriate Government's notification, applies as law, and the Schedule's standard now reaches the Fourth Schedule enactments too.
