Right to Fair Compensation Act

Proceedings Before the Authority and Its Award: Sections 65 to 72

Between the reference and the appeal lies the Authority's working chapter: the Collector's statement that frames the dispute, notice to everyone the money concerns, an enquiry confined to the grounds raised, a public hearing, and an award built on the Act's own valuation principles, carrying solatium on every enhancement, costs, and interest on the excess. This note walks Sections 65 to 72 in their working order.

1. Framing the Dispute: The Collector's Statement

In making the reference, the Collector states, in writing, the particulars the Authority needs: the situation and extent of the land with its plan; the names of the persons interested; the amount awarded for damage and compensation and the grounds of the award; the amount of the R&R award where that is in issue; and, where the objection concerns measurement or apportionment, the relevant particulars. The statement is the reference's charge-sheet: it defines the record the enquiry begins from, and with the applicant's grounds it fixes the dispute's shape.

2. The Enquiry's Discipline

  • Notice: the Authority serves notice of the day of hearing on the applicant, on all persons interested in the objection (except those who have consented without protest to the Collector's award), and on the Collector and the Requiring Body where the objection concerns area or the amount, everyone whose pocket the decision touches is before the forum.
  • Restriction to the grounds: the scope of the enquiry is restricted to a consideration of the interests of the persons affected by the objection, and the objection itself travels on the grounds the Section 64 application stated: the reference is a focused re-determination, not a fresh acquisition trial.
  • Open proceedings: the proceedings are held in public, the open-court principle applied to the tribunal, with the Section 60 powers (summons, discovery, commissions, affidavits) supplying the evidentiary machinery.

3. The Award and Its Contents

  • The determination (Section 69): the Authority determines the compensation on the Act's own principles, the Section 26 market value rules, the Section 28 heads, the Section 29 asset valuations, and on every amount by which it enhances, the statutory additions follow: solatium at 100% and the Act's additional amounts on the enhanced figure, enhancement is of compensation, so it carries compensation's full dress.
  • The form (Section 70): the award is in writing, signed by the Presiding Officer, specifying the amounts awarded under the market-value head and the other Section 28 heads separately, with the grounds of awarding each, a reasoned, itemised instrument, built for the Section 74 appeal to read.
  • Costs (Section 71): costs are in the Authority's discretion, with the Act's working rule that where the Collector's award is not upheld, the costs are ordinarily borne by the Collector, the State pays for the litigation its under-award compelled, unless the claimant's own extravagance earns a different order.
  • Interest on the excess (Section 72): where the Authority's sum exceeds the Collector's, it may direct interest on the excess at 9% per annum from the date of possession to payment, rising to 15% after the first year, the Section 80 pattern applied to the enhancement, so delay in paying the corrected price costs what delay always costs under this Act.

⚠ Key point

Sections 65 to 72: the Collector's written statement frames the reference; notice goes to the applicant, the persons interested, the Collector and the Requiring Body; the enquiry is restricted to the objection's grounds and held in public; the award is written, signed, itemised and reasoned, determined on the Sections 26 to 29 principles with solatium and the statutory additions on every enhancement; costs ordinarily follow the Collector's failure; and the excess carries interest at 9%, then 15%, from possession to payment.
